Does landlord insurance cover damage caused by a tenant in California?

Published 2026-10-13 by Insurance City Agency, LLC, CA License #6003045. Reviewed by Santo Militello, California-licensed Property & Casualty agent (CA License #1737723).

Short answer: it depends on how the damage happened. A landlord (DP-3) policy is built for sudden, accidental physical loss, so a kitchen fire a tenant starts or a washing-machine hose that bursts is usually a covered claim. Slow damage, neglect, pet damage, and ordinary wear and tear usually are not; those are handled through the security deposit under California Civil Code 1950.5 and, past that, a claim against the tenant. Intentional vandalism by a tenant is the gray area, and it is the line on your policy to read first.

It is general information, not legal advice. Your own policy form and endorsements decide every claim.

Which tenant damage does a DP-3 usually pay?

What happenedUsual treatment on a landlord policyWhere else to look
Tenant leaves a pan on the stove and the kitchen burnsFire is a covered peril on the building, minus the deductible. Lost rent while the unit is repaired may fall under fair rental value. The carrier may pursue the tenant or the tenant's renters insurer afterward (subrogation).
Supply line bursts and water soaks the floorsSudden discharge of water is generally covered; the cause of the leak itself may not be.A slow leak the tenant ignored for months can be excluded as continuous seepage.
Holes in walls, broken doors, stained carpet at move-outOften treated as neglect or wear, not a sudden loss. Many claims stop here.Security deposit, itemized within 21 days under Civil Code 1950.5.
Dog chews trim and scratches floorsAnimal damage by a pet kept on the premises is commonly excluded.Deposit; lease pet clause.
An angry tenant deliberately smashes fixturesDepends on the form. Some dwelling policies cover vandalism and malicious mischief by a tenant; others exclude it or need an endorsement.Police report; deposit; small claims or civil claim against the tenant.
Tenant takes the landlord's appliancesTheft by a tenant is commonly excluded on dwelling forms.Police report; claim against the tenant.

Why vandalism by a tenant is the line to check

Ask your agent three questions about your current form, in writing if you can: Does vandalism and malicious mischief apply when the person who did it is the tenant? Is there a separate endorsement for it, and is it on my policy? Does the vandalism coverage stop after the unit has been vacant for a stretch of time? Many dwelling forms suspend vandalism coverage after a long vacancy, which matters between tenants. See vacant rental property insurance for that window.

What the security deposit can cover

California Civil Code 1950.5 lets a landlord use the deposit to repair damage the tenant or their guests caused beyond ordinary wear and tear, and to clean the unit back to its move-in level. It does not allow charging for normal aging of carpet and paint. For tenancies covered by the newer rules, the statute also asks the landlord to take photos at move-in and move-out and before and after repairs, and to send an itemized statement within 21 days after the tenant moves out. Those photos double as claim evidence if the loss is also an insurance claim.

Deposit, claim, or both?

A common sequence for a sudden loss caused by a tenant: report the claim, let the adjuster inspect before repairs, and keep the deposit accounting separate. The deposit cannot be used to pay you twice for the same repair. For damage below your deductible, or damage that is clearly wear or neglect, the deposit is usually the only path, and a claim may simply add a loss to your history.

Steps that make the next claim easier

A Central Valley example, as outcomes

A Stockton owner rents a duplex. Unit A's tenant starts a grease fire; the DP-3 pays the kitchen repair minus the deductible and some lost rent while the unit is closed, then the carrier pursues the tenant's renters insurer. Unit B's tenant leaves with holes in two walls and a ruined carpet; the claim is declined as wear and neglect, and the owner itemizes the repairs against the deposit within 21 days. A third case, a tenant who breaks windows on purpose during an eviction, turns on whether the owner's form covers vandalism by a tenant. No premium or payout is printed here; it depends on the form, the deductible, and the facts.

Frequently asked questions

Does landlord insurance cover damage caused by a tenant in California?

Sudden accidental damage such as fire or a burst pipe is usually covered even if a tenant caused it. Wear and tear, neglect, and pet damage usually are not. Vandalism by a tenant depends on your form.

Can a landlord use the security deposit for tenant damage?

Yes, for damage beyond ordinary wear and tear and for cleaning back to the move-in level, under Civil Code 1950.5, with an itemized statement within 21 days after move-out.

Is pet damage covered by a DP-3?

Usually not. Damage by animals kept on the premises is commonly excluded, so the deposit and lease are the main remedies.

Will my insurer go after the tenant?

After paying a claim, the insurer may seek recovery from the person responsible or their renters insurer. That is the carrier's decision.
