What insurance does a security guard company need in California?

A California company that furnishes guards for pay needs a private patrol operator license from the Bureau of Security and Investigative Services. Business and Professions Code section 7583.40 defines the insurance policy that license requires as commercial general liability of one million dollars ($1,000,000) for any one loss or occurrence due to bodily injury, including death, or property damage, or both. Workers compensation is a separate policy and, under Labor Code section 3700, it starts with the first employee. This is not a CSLB trade. Does a security guard company need a PPO license in California?

According to section 7582, unless a person is specifically exempted by section 7582.2, no person shall engage in the business of a private patrol operator without a license. Section 7582.1 defines that business as agreeing to furnish, or furnishing, a watchman, guard, patrolperson, or other person to protect persons or property or to prevent theft, for any consideration. The same section defines a security guard as an employee of a private patrol operator, or an employee of a lawful business or public agency who is not exempt, who performs those functions. A one-person company that sells guard service to other businesses is in the operator definition. An in-house employee of a store, if the exemption in 7582.2 actually fits, is a different fact. Do security guards need a guard card in California?

Section 7583.3 says a person required to be registered as a security guard shall not fail to carry, while on duty, a valid and current security guard registration card, or the bureau’s approval printout plus photo identification while the card is pending. A firearm on duty requires a valid firearms permit associated with that registration. The same section says the guard shall not carry or use a firearm or a baton, as the chapter allows, unless the guard is an employee of a private patrol operator licensee or an employee of the state or a political subdivision. Armed or unarmed is an application fact. This page does not invent a second statutory liability limit for armed posts. Contracts often ask for more than the statutory floor. Bring the contract.

How much general liability does a PPO need in California?

According to section 7583.40, the minimum is $1,000,000 for any one loss or occurrence for bodily injury, including death, or property damage, or both. That figure is a statutory limit, not a premium. Section 7583.39 makes the policy a condition of issuance, reinstatement, renewal, and keeping the license. If the licensee fails to maintain it, the bureau gives written notice and 30 days to provide proof. After that, the license is suspended by operation of law until proof is on file. The BSIS private patrol operator insurance page says the certificate must show occurrence coverage. Claims-made coverage is not permitted, because it does not cover an incident during the policy term if the claim is filed after the term. The bureau must be the certificate holder so it hears about a cancellation. The address BSIS prints for that holder is Bureau of Security and Investigative Services, P.O. Do security guard companies need workers comp in California?

Yes, from the first employee, under Labor Code section 3700. The PPO liability minimum does not replace compensation. A guard hurt on a post is an employee-injury fact. WCIRB classification 7721(2), Security Guard or Patrol Services, applies to employers that contract with others to provide guard or patrol services to control access, maintain security, public safety, or loss prevention. The phraseology includes guards, bodyguards, street-crossing guards, loss-prevention agents, gate attendants, lobby attendants, and door attendants, armed or not, in uniform or not, at malls, offices, stores, apartments, hospitals, hotels, events, and similar sites.
