Do tree trimmers need workers comp in California?

Yes, once anyone on the crew is an employee. California Labor Code section 3700 requires every employer to secure workers compensation. General liability is the other page a city, an HOA, or a homeowner actually reads on the certificate. The Contractors State License Board class for planting, pruning, and removing trees and palms is C-49. A D-49 tree-service license issued before January 1, 2024 can still be worked, and Business and Professions Code section 7125(b) names D-49, not C-49, on the list of licenses that cannot use a no-employee compensation exemption through January 1, 2028.

The compensation duty is the employment, not the logo on the truck. According to Labor Code section 3700, an employer secures compensation for employees. A sole owner who truly has nobody else on the job is not an employer of another person. A climber paid for the day, a ground person, or a relative on the payroll is an employee for that statute. CSLB adds a filing rule for an active contractor license: a compensation certificate, or a no-employee exemption where the classification still allows one. Section 7125(b), as CSLB posts it, closes that exemption through January 1, 2028 for C-8 concrete, C-20 HVAC, C-22 asbestos abatement, C-39 roofing, and D-49 tree service. Read the license. If it still says D-49, the closed list names that classification. If it says C-49, the statute text that CSLB posts still says D-49. Do not assume the rename moved the exemption. What CSLB license covers tree trimming in California?

According to the CSLB C-49 classification, a tree and palm contractor plants, maintains, and removes trees and palms. The duties include pruning, stump grinding, and tree, palm, or limb guying. CSLB states that this rule does not require a license for incidental pruning of trees, or guying of planted trees and their limbs, by a nurseryperson, or for incidental pruning by a gardener as described in Business and Professions Code section 7026.1. CSLB’s industry bulletin New C-49 Tree and Palm Classification Takes Effect January 1, 2024 says the board stopped accepting C-61/D-49 applications after December 31, 2023, and that applications received after that date are processed as C-49. Contractors who already held D-49 may keep working under it. The bulletin says CSLB regards the classification of the work as the same, even though the written descriptions differ slightly because C-49 names palms. The license number on the wall is the one that goes on the application.

Which workers comp class applies to tree pruning in California?

California compensation is classified by the Workers’ Compensation Insurance Rating Bureau, not by the words on the door. Advisory pure premium rates are published by WCIRB and approved by the Insurance Commissioner. This page does not reprint a rate. The class phraseology is the fact that changes the filing.

What general liability claims show up on a tree job?

These are the loss patterns a tree file has to describe. They are not claim outcomes, and they are not a price.

A limb drops onto a car parked under a valley oak in Stockton, or onto a person on the sidewalk. That person is not the crew’s employee, so the question is general liability, not compensation. The chipper throws a piece into a neighbor’s window. A stump grinder cuts an irrigation lateral the gardener had flagged. An aerial lift in a narrow San Jose side yard creases a stucco wall. A rope or a guy wire left on a palm fails a month later. Whether that later failure is a completed-operations question depends on the form. Say the scope, including removal and any work near a service drop, when the application is filled out. The license bond does not pay these. Liability is the policy the hiring party asked to see. The chip truck and the trailer are a different policy. A personal auto policy is written for personal use. Hauling a chipper to a job is business use. Put the truck, the trailer, and who drives them on commercial auto. Tools that move from yard to yard are an equipment question, separate from the liability suit and separate from the truck.

Is the contractor bond the same as tree-trimmer liability insurance?

No. According to Business and Professions Code section 7071.6, the contractor license bond is $25,000. That figure is the bond penalty, not an insurance premium. The bond is filed with CSLB for the people the bond statute names. A payment by the surety is a debt the contractor owes back. It does not defend the trimmer against the car, the window, or the bystander. An LLC license files an additional worker bond of $100,000 under section 7071.6.5, for wages, interest, and fringe benefits. That is also a bond penalty, not a premium.
