What liquor liability insurance is

Liquor liability insurance is a commercial policy for claims connected to selling or serving alcoholic beverages. The account is usually a bar, a restaurant with a beer and wine license, a market, or a tasting room. It is a different contract from general liability on that same business. Leases and event permits around Stockton often name the liquor form on its own before the landlord will hand over the keys.

California does not turn every drink into a civil case against the seller. Business and Professions Code section 25602(b) says a person who sells, furnishes, or gives alcohol is not civilly liable for injuries inflicted as a result of the drinker's intoxication. Subdivision (c) of that section says the Legislature intends the consumption, not the serving, to be treated as the proximate cause. Section 25602.1 is the narrow opening the other way: a person licensed, or required to be licensed, under section 23300 can be sued for selling or furnishing alcohol to an obviously intoxicated minor when that act is the proximate cause of the injury or death. Civil Code section 1714(c) adds a separate limit for a social host who furnishes alcohol.
