What insurance does a panaderia or Mexican market need in California?

A California panadería or Mexican market needs a health permit from the local enforcement agency before it sells food, and it needs workers compensation as soon as it has an employee. California Labor Code section 3700 is that compensation duty. The Spanish guide already published for taquerías and panaderías is Seguro para taquerías y panaderías. Does a panaderia or Mexican market need a health permit in California?

According to Health and Safety Code section 114381, a food facility shall not be open for business without a valid permit, and the enforcement agency issues that permit. The permit is not an insurance policy. A landlord can still ask for a certificate of liability and property before handing over the keys. Those are separate papers from the health permit and from the seller's permit.

Which workers comp class applies to a panaderia or Mexican market?

According to the WCIRB article on baked-goods manufacturing, effective September 1, 2025, classification 2003, Baked Goods Manufacturing, retail, applies when more than half of gross receipts come from selling baked goods to the public, or from transferring them to the employer's own retail stores or restaurant locations. The article says 2003 also applies to bakery departments inside grocery stores. The products it names include bread, pastries, empanadas, cookies, tortillas, and doughnuts. Classification 2004, Baked Goods Manufacturing, wholesale, applies when more than half of gross receipts come from sales to wholesale customers.

A market that mainly sells groceries, produce, and household goods is not described as 2003. The 2025 abbreviated classification listing names 8006(1), Stores, groceries, retail, as its own line. A hot-food counter inside that market, if it cooks food to order for walk-in customers, is discussed on the restaurant classification page as 9081(1), not as the grocery floor. A store that sells baked goods as one more retail item, and that is not a manufacturing bakery, can fall in 8017(1), Stores, retail, N.O.C., which the 8017(1) phraseology says includes baked goods among other goods not given their own store class. This page does not reprint a pure premium rate, and it does not guess the split when one employee both bakes and rings the register. WCIRB requires payroll records before payroll is divided.

What does a market package leave out?

A business owner's package, when a carrier offers one, is liability for a customer in the aisle plus property for the cases, the oven, and the inventory at that address. It does not include workers compensation. It does not automatically include spoilage when a walk-in fails, and it does not automatically include breakdown of the oven.
