What does a retail store BOP cover in California?
Published 2026-10-06 by Insurance City Agency, LLC, CA License #6003045. Leer en español
No California statute cited on this page requires a clothing, gift, or general-merchandise store to buy a business owner's policy. When a carrier offers that package, it is liability for a customer in the aisle plus property coverage for the store's own fixtures and inventory at the address. California Labor Code section 3700 still requires workers compensation on a separate policy from the first employee. A furniture showroom is a different class and a different guide.
What does a retail store BOP cover in California?
The package is written for the shop, not for a couch on a delivery truck. A customer who trips on a rug at the register, a box that falls from a high shelf onto a shopper, and damage the store causes to the landlord's unit are liability facts. The racks, the point-of-sale terminal, and the merchandise the store owns are property facts. Business income is included only when the declarations show it. Shoplifting of the store's own goods is a crime-and-inventory question. It is not a bodily-injury claim, and this page will not say a liability form pays it.
The statewide explanation of what the package leaves out is BOP exclusions. The product page is business owner's package. City guides that already exist are Stockton and Modesto.
Does a retail store BOP include workers comp in California?
No. Compensation starts with the first employee, including a Saturday clerk, under Labor Code section 3700. It is not folded into the package. A personal auto policy does not cover a store van that runs bank deposits. That van is commercial auto.
The compensation class follows what is sold, not the word "retail" on the door. According to the 2025 WCIRB abbreviated listing, 8008 is stores selling clothing, linens, or fabric at retail; 8006(1) is grocery stores at retail; 8061 is convenience stores at retail; 8039 is department stores. According to the 8017(1) phraseology, stores selling goods that are not given a more specific store class, including cosmetics, party supplies, toys, and sporting goods, are 8017(1), Stores, retail, N.O.C. A furniture store is classification 8015, and that page is furniture store BOP. Do not file a clothing rack as a furniture showroom, and do not file a mattress-only shop as this page. This page does not reprint a pure premium rate.
How is a retail store different from a furniture store?
A gift shop and a clothing shop keep inventory on gondolas and hangers. The customer carries the bag out. There is no in-home assembly of a sofa and no WCIRB furniture phraseology for a designer who travels to a living room. A furniture store's delivery payroll, showroom samples, and cabinet or floor-covering side operations are written on the furniture page. If this store also sells a few picture frames or lamps, say so on the application. Do not assume that side table moves the whole payroll to 8015.
What should a retail owner send with the quote form?
Send what is on the shelves, the address, whether anyone is employed, whether a vehicle leaves the shop, and the landlord's insurance exhibit if the lease has one. Insurance City Agency, LLC reads that packet on the quote form.
