What does a California auto repair, tire, or body shop need besides general liability?

Short answer: a shop that repairs or diagnoses cars for pay, body work included, is an "automotive repair dealer" under Business and Professions Code section 9880.1, and section 9884 requires it to register with the state for each place of business. A mobile repair operation lists the license plate of the service vehicle on that registration. Workers compensation applies from the first technician under Labor Code section 3700. None of those filings is insurance for the customer's car. A standard general liability policy is usually written to exclude property in your care, custody, or control, and the customer's car on your lift is exactly that. What goes wrong in a bay, and which policy answers

A customer's SUV slips off a two-post lift during a brake job in a Stockton shop. Three different things just happened. The technician who jumped back and hurt a shoulder is a workers compensation claim. The SUV is a customer vehicle in the shop's care, which is a garagekeepers question, not general liability. If the SUV had rolled into a customer standing in the waiting area, that injury would be garage or general liability. One accident, three policies.

The test drive is the second common loss. A tech takes a customer's sedan around the block on March Lane after a suspension repair and rear-ends a pickup at a light. The damage to the pickup and its driver is an auto liability question for the shop's operations, often handled on a garage policy. The damage to the customer's own sedan goes back to garagekeepers. Which one pays depends on the forms, so ask how your policy handles customer cars that are being driven, not only parked.

Overnight is the third. Cars waiting for parts sit in the lot behind a chain-link fence. A fire in the paint booth, a break-in, or catalytic converters cut from three customer cars all happen while nobody is there. Our catalytic converter theft article covers the owner side. For the shop, the question is whether garagekeepers is written on a legal liability basis, which pays only when the shop is legally responsible, or on a direct basis, which can pay regardless of fault. Direct wording is often available as primary or as excess over the customer's own auto policy. Customers usually assume the shop "has insurance for that." Read the declarations before they ask.

The fourth loss shows up weeks later. A wheel comes off on Highway 99 because the lug nuts were not torqued. That is a completed-work claim against the shop. Tire shops and mobile tire crews see it most. It is also why we ask about torque procedures and sign-off sheets when we quote.

Garage liability and garagekeepers are not the same thing

Garage liability protects the shop when it is sued by other people for bodily injury or property damage that comes from running the business: the premises, the work, and in many forms the shop's use of vehicles. Garagekeepers covers damage to customers' vehicles while they are in the shop's care, custody, or control. A shop with only general liability and no garagekeepers has a policy that may answer for the customer who trips in the lobby and not for the customer's car on the lift. Frequently asked questions

Does an auto repair shop in California have to register with the state?

Yes. Business and Professions Code section 9880.1 defines an automotive repair dealer as a person who repairs or diagnoses malfunctions of motor vehicles for compensation, and section 9884 requires the dealer to register with the director for each place of business. Body repair work is included in the definition of repair.

What is the difference between garage liability and garagekeepers?

Garage liability responds when other people sue the shop for injury or damage caused by its operations. Garagekeepers covers damage to customers' vehicles while they are in the shop's care, custody, or control. A general liability policy usually excludes property in the shop's care, which is why garagekeepers is a separate coverage.

What is legal liability versus direct garagekeepers?

Legal liability wording pays only when the shop is legally responsible for the damage to the customer's car. Direct wording can pay regardless of fault, and is often available as primary or as excess over the customer's own auto policy. The choice changes how a fire, theft, or storm loss in the lot is handled.

Does a tire shop need a registration to haul used tires?

Public Resources Code section 42951 says a person who transports waste or used tires must hold a waste and used tire hauler registration unless an exemption in section 42954 applies, and may take the tires only to a facility authorized to accept them.

Do I need workers compensation if my only helper is part time?
