What general liability does a church or nonprofit need?
Definition: general liability pays for bodily injury and property damage claims from your premises and activities, plus defense costs, up to the limit on the declarations. A visitor who trips in the foyer, a food-distribution line, or a rented hall is the usual claim. Many landlords and denominational offices ask for $1 million per occurrence and $2 million aggregate, plus an additional-insured endorsement for the landlord. What property coverage does a congregation need?
If you own the building, property insurance should track replacement cost of the sanctuary, fellowship hall, and contents you own: sound equipment, pews, kitchen gear. If you rent, the lease states whether you insure the building, the tenant improvements, or only your contents. Earthquake and flood are separate. Why is abuse and molestation coverage separate?
Definition: abuse and molestation liability responds to claims that a child or vulnerable adult was harmed by someone connected to the organization, including defense of the church or nonprofit. Many general liability forms exclude those claims or cap them far below what a school, landlord, or denomination requires. Youth ministry, nurseries, and overnight trips are the activities underwriters ask about. Ask to see the exclusion in writing before you bind, and match the limit to the requirement in the lease or the denominational checklist. Background-check practices are an underwriting fact, not a promise that a claim will be paid.
What does directors and officers insurance do for a board?
Directors and officers (D&O) insurance defends board members and the organization against claims about how the nonprofit was governed: a disputed firing, a misuse-of-funds allegation, or a decision a donor challenges. It is not premises liability. Small church plants with a three-person board still have the exposure the day someone is paid or a gift is restricted. What is volunteer accident coverage?
Volunteer accident coverage is a medical-expense policy for unpaid helpers injured while serving: a volunteer who falls setting up chairs, or a driver who is hurt loading a van. It is not workers’ compensation and it is not a lawsuit policy. California Labor Code §3352 generally treats unpaid volunteers of a nonprofit as outside the employee definition when they receive no pay beyond meals, lodging, transportation, or incidental expenses. Does a church van need owned auto or hired and non-owned auto?
A van the church owns needs a commercial auto policy for liability and, if you want it, physical damage. Hired and non-owned auto covers liability when an employee or volunteer drives a personal car, or a short-term rental, on church business. It does not repair a vehicle the church owns, and it does not replace the volunteer’s own auto policy for that person’s personal use. When does a church need workers’ compensation?
When you have employees. Labor Code §3700 requires an employer to secure workers’ compensation. A paid pastor, secretary, musician, or custodian is the usual trigger. Unpaid volunteers are a different category under §3352. There is no headcount minimum and no grace period once payroll starts. The premium follows payroll and class, not the county name. How do events change the insurance a congregation needs?
Sunday service on your own premises is usually inside general liability. A festival in a park, a rented banquet hall, a bounce house, a food vendor, or a crowd above your usual attendance can need an event endorsement or a separate special-event policy, plus a certificate naming the city or the venue. If alcohol is served, liquor liability is its own question. List the dates before the event, not after a claim.
