What does escrow need from your homeowners insurance on a new San Joaquin County home?

Escrow needs written evidence of insurance before the loan funds: a binder or a declarations page that names the buyer, the street address or lot, the dwelling limit, the effective date, and the lender as mortgagee with its loan number. The escrow officer forwards it to the lender. Without it, the file waits, even when the builder has the house ready.

Plain definition: a mortgagee clause is the line on the policy that names your lender, so a claim check for the house is payable to you and the lender together, and the lender is told if the policy ends. The exact wording comes from the lender's closing instructions, so copy it from those instructions rather than from a past policy.

How much dwelling coverage can a lender require?

A lender in California cannot require hazard coverage above the replacement value of the buildings. Civil Code section 2955.5(a) sets that limit. The land does not burn, so the purchase price, which includes the lot, is not the number the dwelling limit is built from. The limit comes from the plan size, the construction, the garage, and features such as solar, a casita, or a covered patio.

New builds are where buyers most often see the gap. A base price, a lot premium, and design-studio upgrades add up to the contract price, but only the parts that would be rebuilt after a loss belong in the dwelling figure. Send the plan sheet and the upgrade list, and the rebuild estimate is made from those.

Binder, declarations page, or impound account: what is the difference?

These three get mixed up during a closing. The binder proves coverage starts on the closing date. The declarations page shows the issued policy. An impound account, also called an escrow account, is how some loans collect the insurance premium and property tax with each mortgage payment.

BinderEscrow and the lenderBefore funding, while the policy is being issued.
Declarations pageYou and the lenderAfter issue; it lists the limits, deductibles, and mortgagee.
Impound (escrow) accountThe loan servicerEvery month after closing, if your loan has one. Federal rules for these accounts are in 12 CFR 1024.17.
Supplemental property tax billThe county and youAfter the county sets a new value for the sale or the finished construction.

Why does a supplemental tax bill matter for a new home?

San Joaquin County reassesses a property when ownership changes or new construction is completed, and creates a supplemental assessment for the difference. The County Assessor says supplemental bills or refunds are mailed only to the property owner. Ask your servicer whether the impound account will pay that bill, or whether you will.

The same office mails new owners an application for the Homeowners' Exemption if the home is your principal residence. Neither item changes your insurance, but both arrive in the same months as your first policy bill, so it helps to know which mail is which.

How do you get from a signed contract to evidence of insurance at escrow?

  1. Send the builder, plan, square feet, stories, garage bays, solar owned or leased, lot or address, and the projected close date as soon as the contract is signed.
  2. Send the lender's legal name, loan number, and mortgagee clause exactly as written in the closing instructions.
  3. Look up the parcel on FEMA Map Service Center. If the building is in a special flood hazard area and the loan is from a regulated lender, federal law at 42 U.S.C. 4012a requires flood insurance, which is a separate policy.
  4. Decide on earthquake coverage. It is not part of a standard homeowners policy; the California Department of Insurance explains how it is offered.
  5. Choose the policy. Evidence of insurance goes to the escrow officer and the lender with the closing date as the effective date.
  6. If the close date moves, tell us the new date so the binder matches the funding day.
  7. After recording, send the final street address if the lot number was used, so the policy and the deed match.

What if the policy lapses after closing?

If the servicer does not see coverage, it can buy insurance for the house itself and bill you for it. Federal rules on that step, including the notices the servicer must send first, are in 12 CFR 1024.37. Keep the mortgagee clause current if the loan is sold, and forward any servicer letter about insurance to us.

Frequently asked questions

When should I start homeowners insurance for a new build in San Joaquin County?

Start when the purchase contract is signed, not in the walk-through week. Escrow needs evidence of insurance naming the lender before the loan funds, and a plan sheet takes time to rate. Starting early leaves room if the close date moves.

Can my lender make me insure the house for the full purchase price?

No. California Civil Code section 2955.5(a) says a lender cannot require hazard coverage above the replacement value of the buildings. The purchase price includes land, which is not rebuilt after a loss.

Does the impound account pay the supplemental property tax bill?

Ask your servicer. The San Joaquin County Assessor says supplemental bills are mailed only to the property owner, so the bill may come to you even if your loan has an impound account.

Is flood insurance part of the homeowners policy?

No. Flood is a separate policy. Look up the parcel on FEMA Map Service Center; if the building is in a special flood hazard area and the loan is from a regulated lender, federal law requires flood coverage.
